The Interim Regulations of Liaoning Maritime Safety Administration on Offshore Wind Power Traffic Safety Supervision and Administration are hereby issued, which will come into force on July 1, 2023 and be valid for two years.

Interim provisions






Chapter I General rules


Article 1 In order to strengthen the management of offshore wind power Marine traffic, prevent and control ship pollution of the Marine environment, and maintain the order of Marine traffic, These Provisions are formulated in accordance with the Maritime Traffic Safety Law of the People's Republic of China, the Work Safety Law of the People's Republic of China, the Regulations on the Prevention and Control of Marine Environment Pollution by Ships, the Regulations of the People's Republic of China on the Safety Administration of Navigation for Operations and Activities on Water and Underwater, the Rules of the People's Republic of China on Ship Safety Supervision and other laws, administrative regulations and rules.


Article 2 These Provisions shall apply to offshore wind power planning, project approval, construction, operation and maintenance, disposal and other activities related to maritime traffic safety and prevention and control of Marine environment pollution by ships in the sea areas under the jurisdiction of the Liaoning Maritime Safety Administration.


Article 3 The Liaoning Maritime Safety Administration shall be the competent authority to implement these Provisions.


Each branch of the Maritime Safety Bureau of the Liaoning Maritime Safety Administration is responsible for the supervision and management of offshore wind power Marine traffic safety and the prevention and control of Marine environmental pollution by ships in accordance with their duties and powers.


Article 4 Owners of offshore wind power, construction units, operation and maintenance units as well as relevant vessels and personnel shall abide by the laws, administrative regulations and rules on maritime traffic safety and prevention and control of pollution of the Marine environment by ships, as well as mandatory standards and technical norms.


Article 5 Encourage and support the application of advanced science and technology in the management of offshore wind power Marine traffic safety and prevention of Marine environmental pollution from ships, and improve the level of digital, intelligent and information management of offshore wind power.


Chapter II Guarantee of maritime traffic conditions


Article 6 The preparation of the offshore wind power development plan shall take full account of site selection, Marine hydrology, engineering geology, and factors affecting safety in transportation, reasonable avoidance planning or announced maritime traffic functional zones, and scientifically determine the location, layout and safety facilities construction of offshore wind power.


Article 7 Before the approval of an offshore wind power project, the owner unit shall conduct an impact analysis on navigation safety according to the navigation environment of the sea area and the current situation of ship traffic flow, analyze the impact of project construction and operation on the navigation, berthing and operation of ships, study and judge major risks to navigation safety, and determine navigation safety safeguard measures.


Article 8 The clear distance between the offshore wind power facilities of the offshore wind power project and the boundary line of the planned or announced Marine traffic functional area should not be less than 2 nautical miles, and the clear distance between the submarine cable and the planned or announced anchorage boundary line should not be less than 1 nautical mile.


Article 9 The submarine cable of the offshore wind power project shall be reasonably designed and buried according to the impact analysis of navigation safety, so as to avoid the impact on navigation safety.


Article 10 Subject to the natural conditions of the sea area, Marine environmental protection, protection of military facilities and other restrictions, offshore wind power projects have one of the following circumstances, the owner unit shall conduct a special study, and take special navigation safety measures:


(1) The net distance between the offshore wind power facilities and the boundary lines of the planned or announced Marine traffic functional zones is less than 2 nautical miles;


(2) The clear distance between the submarine cable and the boundary line of the planned or announced anchorage is less than 1 nautical mile;


(3) The submarine cable traverses other maritime traffic functional areas except anchorage.


Article 11 An offshore wind power project may not damage or hinder the working efficiency of the Marine traffic support service system and the navigation, communication and other equipment of ships in the surrounding waters. If damage or obstruction is caused, the owner unit shall make proper arrangements.


Article 12 The layout of offshore wind power projects shall meet the requirements for navigation, berthing and operation of construction vessels and operation and maintenance vessels.


Article 13 The owner unit shall, in accordance with the impact of the offshore wind power project on navigation safety, be equipped with appropriate Marine traffic safety facilities, and simultaneously design, construct, and put into production and use with the main project. Investment in maritime traffic safety facilities shall be included in the budget estimates of offshore wind power construction projects.


Article 14 The owner unit shall, according to the location of the offshore wind power project and the safety requirements of the construction ship and the operation and maintenance ship, consider the construction base and operation and maintenance dock as a whole.


The construction base shall meet the requirements for berthing and loading and unloading of construction vessels, and the operation and maintenance dock shall meet the requirements for berthing of operation and maintenance vessels and embarkation and departure of persons going to sea.


15th offshore wind power projects have one of the following circumstances, the relevant departments shall fully solicit the opinions of the maritime administration, ensure the safety of navigation, reserve maritime search and rescue channels:


(1) Project approval;


(2) The project and its surrounding sea areas of Marine ranching, offshore photovoltaic, seawater hydrogen production, Marine cultural tourism and other integration projects;


(3) Examination and approval for the use of the project and its surrounding sea areas;


(4) The project and its surrounding sea area aquaculture certificate.


Chapter III Supervision and administration of Marine traffic safety during construction


16th offshore wind power project for the following construction operations, shall be in accordance with the provisions of the construction license, and approved the corresponding safe operation area:


(1) geological exploration;


(2) Construction, maintenance and dismantling of offshore wind power facilities;


(3) Laying, repairing and dismantling submarine cables.


Where an offshore wind power project involves two or more branches of the maritime Administration, the application for the license shall be submitted to the Liaoning Maritime Administration or the designated branch of the Liaoning Maritime Administration.


Article 17 The owner unit and the construction unit shall establish and improve the responsibility system and rules and regulations for Marine traffic safety and prevention and control of pollution of the Marine environment by ships during construction, improve production safety conditions, implement the main responsibility for navigation safety, ensure the safety of construction ships, personnel going to sea, operations and the traffic in the surrounding sea areas, and prevent and control pollution of the Marine environment by construction ships.


In case of subcontracting, the general contractor of the project shall be responsible for implementing the main responsibility of navigation safety of the construction unit.


Article 18 Owners and construction units are encouraged to establish maritime search and rescue teams with neighboring construction, operation and maintenance, ports, shipping companies and other social forces, and make comprehensive use of ships, aircraft and other rescue forces for maritime search and rescue.


Article 19 The owner unit shall sign the Marine traffic safety management agreement with the construction unit, regularly supervise and evaluate the construction unit and make a good record, and urge the construction unit to establish and implement the Marine traffic safety management system and implement safety measures.


Article 20 The construction unit shall, in accordance with the construction operation plan, safeguard measures, emergency plan and responsibility system, use the approved construction vessel suitable for navigation, berthing and operation to carry out operations in the safe operation area, and notify the operation progress and plan in a timely manner.


Safety operation areas shall be set up with relevant safety warning signs, equipped with necessary safety facilities or warning ships.


Article 21 The construction unit shall establish and implement a maritime traffic safety management system, including construction vessels and personnel and vessels and personnel serving construction operations, regular supervision and assessment and make records.


The maritime traffic safety management system shall at least include:


(1) Safety conditions for the navigation, berthing and operation of the vessel;


(2) ship organization and dispatching system;


(3) the system of regular and voyage inspection of ships;


(4) the system for reporting ship movements and emergency situations;


(5) bad weather management system for ships;


(6) Safety management system for ships carrying non-crew members;


(7) Management system for preventing and controlling Marine environmental pollution from ships;


(8) Maritime traffic safety education and training system for sea-going personnel;


(9) Management system for sea-going personnel;


(10) Maritime emergency exercise system.


Article 22 The emergency plan of the construction unit shall at least include:


(1) Emergency plans for accidents or dangerous situations such as collision, running off anchor, loss of control, fire, explosion or sinking of the ship;


(2) contingency plans for ships against bad weather;


(3) emergency response plan for ship pollution accidents;


(4) Emergency plan for persons falling into water at sea;


(5) Emergency plan for the evacuation of personnel at sea.


The construction unit shall select at least one emergency drill every month according to the contents of the emergency plan.


Article 23 The construction unit shall sign a maritime traffic safety responsibility letter with the construction vessel and urge it to implement the requirements for maritime traffic safety and prevention of pollution of the Marine environment by vessels, including at least:


(1) observe the safety conditions of navigation, berthing and operation;


(2) Holding valid legal certificates and instruments;


(3) Meet the minimum safety staffing requirements;


(4) Establish a self-inspection system before sailing, and comply with the provisions of inclement weather restrictions on sailing;


(5) to make reports on the entry and exit of ships;


(6) To equip and turn on the ship's automatic identification system in accordance with regulations, display the signal type, and assign special personnel to watch and listen on the designated channel;


(7) Timely receiving and processing of maritime traffic safety information such as inclement weather;


(8) The total number of crew members and non-crew members on board shall not exceed the quota of passengers in life-saving facilities, and the personnel shall hold relevant certificates or certificates in accordance with relevant regulations;


(9) berth at a place that meets safety conditions;


(10) To discharge and receive pollutants such as ship refuse, domestic sewage, residual oil and oily sewage;


(11) Comply with the relevant requirements for prevention and control of air pollution in the ship emission control area;


(12) Conducting lead seal management of ship sewage discharge equipment in accordance with regulations.


Article 24 The construction unit shall, in accordance with the characteristics of the vessel under construction and its anchoring capacity, choose a place for its daily berthing and emergency shelter from wind, and equip it with sufficient tug boats to assist non-self-propelled vessels to complete the work of preventing and resisting bad weather and evacuating persons at sea.


Article 25 Where a large non-self-propelled vessel is towed, it shall submit the towing inspection certificate issued by the ship inspection institution for inspection, take special safety measures such as strengthening of the towing site and escort, report the navigation plan to the local branch of the maritime administration before sailing, and display signals and hang signs in accordance with relevant provisions.


Article 26 The construction unit shall strengthen maritime traffic safety education and training for personnel going to sea during the construction period.


Seafarers shall be familiar with the navigable environment of the sea area under construction.


Construction personnel shall be familiar with the overall layout, safety equipment operation, contingency deployment, emergency rescue, safety management on board the construction ship, and master the construction operation plan, safeguard measures, emergency plan and responsibility system.


Article 27 The construction unit shall implement classified management of the personnel going to sea, and register the number of the personnel going to sea, identity information, sailing time, return time and other information.


Article 28 Persons going to sea are encouraged to wear communication equipment, electronic equipment with positioning or alarm functions, thermal insulation lifesaving equipment and other protective equipment and equipment.


Article 29 The owner unit and the construction unit shall promptly remove navigation obstacles generated in the course of construction, and shall not leave any hidden danger that may hinder navigation and operation safety. Before the navigation obstacles are removed, prescribed signs and display signals shall be set up, and the name, shape, size, position and depth of the navigation obstacles shall be accurately reported to the maritime bureau of the local branch.


Article 30 The owner unit shall, after the completion of the offshore wind power project, clarify the operation and maintenance, maritime search and rescue and navigation conditions of the vessel, and report the technical parameters related to navigation safety such as the scope of the project sea area, the coordinates of offshore wind power facilities, the routing and burial depth of submarine cables, and Marine traffic safety facilities to the local branch of the maritime Bureau for the record, and the navigational notice shall be issued by it.


Chapter IV Supervision and administration of maritime traffic safety during operation and maintenance


Article 31 The owner units and operation and maintenance units shall establish and improve rules and regulations for maritime traffic safety and prevention and control of pollution of the Marine environment by vessels during operation and maintenance, ensure the safety of maritime traffic by vessels and persons going to sea, and prevent and control pollution of the Marine environment by vessels.


The rules and regulations of the owner's unit and the operation and maintenance unit shall at least include the contents of item (1) to Item (10) of paragraph 2 of Article 21 of these provisions.


Article 32 The owner unit and the operation and maintenance unit shall formulate an emergency plan during the operation and maintenance period, including at least the contents of item (1) to item (5) of the first paragraph of Article 22 of these provisions.


The owner unit and the operation and maintenance unit shall, in accordance with the contents of the emergency plan during the operation and maintenance period, select at least one emergency drill every six months.


Article 33 The owner unit and the operation and maintenance unit shall urge the operation and maintenance vessel to implement the requirements for maritime traffic safety and prevention and control of ship pollution of the Marine environment, including at least the contents of the first paragraph (1) to (12) of Article 23 of these provisions.


Article 34 Owner units and operation and maintenance units shall comply with the relevant requirements of Article 18 of these Provisions to improve the level of maritime search and rescue during operation and maintenance.


Article 35 The owner unit and the operation and maintenance unit shall strengthen the maritime traffic safety education and training of the personnel going to sea during the operation and maintenance period.


The crew members shall be familiar with the offshore wind power project and the navigation environment of the surrounding sea area.


The operation and maintenance personnel shall be familiar with the general arrangement, operation of safety equipment, contingency deployment, emergency lifesaving, safety management on board the operation and maintenance ship.


Article 36 The owner unit shall monitor, alert and dispose of the sea area of the offshore wind power project, remind passing ships to avoid the offshore wind power facilities, and ensure the safety of navigation in the sea area of the project.


Owners are encouraged to implement integrated operation and maintenance management of offshore wind power projects through joint operations and other means.


Article 37 The owner unit shall regularly maintain the maritime traffic safety facilities to ensure their effective operation.


Article 38 The owner shall take regular scanning, review, monitoring and other protective measures to protect the submarine cable, to avoid the submarine cable does not meet the design buried depth, routing and navigation safety technical parameters of the record does not affect the safety of navigation.


39th owner units shall be clear operation and maintenance of the ship berthing, shelter from the wind and the embarkation and departure of personnel, reasonable planning of operation and maintenance of ships in and out of the offshore wind power project sea routes.


Article 40 The owner unit shall be equipped with safety protection facilities for the embarkation and disembarkation of the vessel to ensure the safety of the embarkation and disembarkation of the vessel.


The equipment and equipment provided by the sea-going personnel shall comply with the relevant requirements of Article 28 of these provisions.


Article 41 The owner unit shall assess the impact of sea ice on offshore wind power projects, and take appropriate safeguard measures to prevent sea ice from causing harm to offshore wind power facilities, operation and maintenance vessels, and personnel going to sea.


Article 42 Except for special circumstances such as emergency response of offshore emergencies, emergency repair of offshore wind power facilities or submarine cables, the operation and maintenance vessels shall not, in principle, carry the staff of offshore wind power facilities into and out of the sea area of offshore wind power projects at night.


Article 43 Where a construction vessel is used to construct, maintain or dismantle offshore wind power facilities or lay, overhaul or dismantle submarine cables during operation and maintenance, the relevant requirements in Chapter III of these Provisions shall be observed.


Article 44 When sailing through an offshore wind power project and its surrounding waters, a ship shall strengthen its lookout and maintain a safe speed. If it needs to anchor in an emergency, it shall maintain a safe distance from offshore wind power facilities and submarine cables.


Chapter V Supervision and administration of Marine traffic safety of abandoned offshore wind power facilities


Article 45 Prior to the disposal of offshore wind power facilities, the owner shall conduct a special study to determine the disposal plan and navigation safety measures after the disposal, and report to the maritime safety Bureau of the local branch.


When all offshore wind power facilities are dismantled, the seabed cutting depth of residual pile legs shall be clearly defined.


Article 46 After dismantling offshore wind power facilities, the owner shall remove the abandoned materials and scan the relevant sea areas to restore the water depth conditions and traffic functions.


Article 47 The owner unit shall strengthen the daily maintenance and management of the offshore lien part of the abandoned offshore wind power facilities, and set up special navigational beacons according to the circumstances.


Chapter VI Supervision and inspection


Article 48 The maritime administrative agency shall perform the supervision and inspection duties of offshore wind power Marine traffic safety and prevention and control of Marine environmental safety caused by ships in accordance with the law, and the relevant units and individuals shall cooperate and shall not refuse or hinder the supervision and inspection carried out in accordance with the law.


Article 49 Where the owner unit or the construction unit fails to fulfill the main responsibility for navigation safety, the maritime administrative agency shall interview the owner and order him to make corrections in accordance with relevant provisions; Those who refuse to make corrections shall be ordered to stop their operations.


Article 50 Any unit or individual shall have the right to report to the maritime administrative authority maritime traffic accidents, dangerous situations and illegal acts of ships during the construction, operation and maintenance of offshore wind power and its abandonment. After receiving a report, the maritime administrative agency shall promptly verify and handle it.


Chapter VII Supplementary Provisions


Article 51 The meanings of the following terms in these Provisions are:


Maritime traffic functional zones refer to specific sea areas such as air routes, sea lanes, anchorages and ship alignment areas that guarantee the safety of navigation, berthing and operation of ships.


Offshore wind power facilities refer to fixed or floating buildings and installations such as offshore fans, booster stations and wind measuring towers.


Maritime traffic safety facilities refer to the general term of equipment, installations, installations, structures (construction) and other technical measures used to prevent maritime traffic accidents. It includes navigation environment perception, navigation risk identification, navigation safety guarantee, sea area warning, ship dynamic monitoring, navigation ship identification, preventing ship collision, hydrometeorological monitoring, bad weather early warning, accident and danger disposal and other functions.


Construction vessels refer to installation vessels, lifting vessels, piling vessels, submarine cable laying vessels, barges, tugs, warning vessels, traffic vessels, lifting (throwing) anchor vessels, mobile platforms and other mobile devices used during the construction of offshore wind power projects.


Operation and maintenance ship refers to the ship used for operation and maintenance during the operation and maintenance of offshore wind power projects.


The term "construction personnel" refers to the personnel, other than crew, engaged in temporary or long-term technical, management and service work on board the vessel under construction.


Severe weather refers to typhoon, cold wave, gale, fog, sea ice and other meteorological disasters.


Article 52 Where these provisions are inconsistent with the provisions of laws, administrative regulations, rules and superior normative documents, the provisions thereof shall apply.


Article 53 The Liaoning Maritime Safety Administration of the People's Republic of China shall be responsible for the interpretation of these provisions.


Article 54 These Provisions shall come into force as of July 1, 2023 and shall be valid for two years.
